Terms of Use

The terms on which this website, its forms and its payment facilities are offered.

These Terms govern the use of www.delhiarbitrationcentre.com

1. Acceptance and identity

This website is published by the Delhi Arbitration Centre ("DAC", "the Centre"), a society registered under the Societies Registration Act, 1860, with its office at 37/8, Rajpur Road, Civil Lines, Tis Hazari, Delhi – 110054. By using this website you accept these Terms of Use, together with the Privacy Policy, the Refund & Cancellation Policy and the Disclaimer, each of which forms part of these Terms. If you do not accept them, please do not use the website.

2. Information, not advice

The contents of this website — including descriptions of arbitration, mediation and conciliation, references to statutes and judgments, model clauses, guides and articles — are general information about the Centre and its services. They are not legal advice, and your use of the website creates no advocate–client or other professional relationship with the Centre, its office bearers or any member of its panel. Parties should take independent legal advice on their own disputes. In the event of any inconsistency between the contents of this website and the DAC Rules, the notified Fee Schedules or an order of a tribunal, the Rules, Schedules and orders prevail.

3. Filings and forms

The website enables you to submit forms — including a Request to file a reference, internship applications and membership applications. Submission of a form is a request to the Centre; it does not by itself constitute registration of a reference, acceptance of an application, or the creation of any right or obligation. Registration, acceptance and further steps are communicated by the Registry. You are responsible for the accuracy and completeness of the information and documents you submit, and you confirm that you are entitled to submit them. Timelines under any law or contract are your own responsibility; a website submission does not stop or satisfy a limitation period unless and until the reference is registered in accordance with the DAC Rules.

4. Fees and payments

Fees are payable strictly in accordance with the Centre's notified Fee Schedules and the DAC Rules. Online payments are accepted only through the official payment gateways presented on the Fee Payment page of this website — presently ISGPay for DAC administrative fees (Head I) and Razorpay / Cashfree for arbitrator's fees and related charges (Head II) — or by pay order / demand draft deposited with the Centre against a receipt, drawn as stated on the Fee Payment page. Payment through RTGS, NEFT, cash deposit or direct bank transfer is not permitted; any bank account details published in the past stand withdrawn. The Centre never asks for payment into any personal account or UPI ID; treat any such demand as fraudulent and report it to the Registrar. Gateway convenience charges, where applicable, are borne by the payer. The Fees Calculator on this website produces indicative computations only; the notified Fee Schedules govern. Payment of a fee does not by itself confer any right to registration, appointment or any outcome.

5. Intellectual property — and your licence to use the DAC clauses

The contents of this website, including its text, design, illustrations, logo and emblem, are the property of the Centre or its licensors and are protected by law. You may view, download and print pages for your own reference. You may not reproduce the website's content commercially, scrape it systematically, or use the Centre's name, logo or emblem without written permission. One express exception: the model dispute-resolution clauses published on the DAC Clauses page are meant to be copied — the Centre grants every person a free licence to reproduce those clauses, verbatim or adapted, in their own contracts and agreements.

6. Acceptable use

You agree not to misuse the website: not to attempt unauthorised access to any part of it or its systems; not to upload malicious code; not to submit false, misleading or impersonating information in any form; not to use the website to harass any person; and not to interfere with its availability to others. The Centre may suspend or restrict access, and may decline to act on any submission, where it reasonably suspects misuse or fraud.

7. Third-party links

The website links to external resources — including Government portals (such as odr.msme.gov.in), official press releases and payment gateway pages. These are provided for convenience and verification. The Centre is not responsible for the content or availability of external sites, and a link is not an endorsement of anything found there.

8. Limitation of liability

The website is provided on an "as is" and "as available" basis. While the Centre takes care to keep the website accurate and available, it does not warrant that the website will be uninterrupted or error-free. To the fullest extent permitted by law, the Centre, its office bearers, employees and panel members shall not be liable for any indirect or consequential loss arising from the use of, or inability to use, this website or its contents. Nothing in these Terms limits any liability that cannot be limited by law, and nothing in them affects the rights and obligations of parties in a proceeding under the DAC Rules, which are governed by those Rules and by applicable law.

9. Indemnity

You agree to indemnify the Centre against claims and losses arising from your breach of these Terms, including the submission of false information or material you were not entitled to submit.

10. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any applicable law, the courts at Delhi shall have exclusive jurisdiction over disputes concerning the use of this website. This clause governs the website only; disputes referred to the Centre for resolution are governed by the parties' own agreements and the DAC Rules.

11. Changes and contact

The Centre may revise these Terms from time to time; the version published here, with its effective date, is operative. Questions about these Terms may be addressed to the Registrar, DAC at [email protected] or +91-9315100181.
